This Privacy Policy explains how WineExam (“WineExam,” “we,” “us,” or “our”) collects, uses, stores, and shares information when you use the WineExam mobile applications, website, and related services (collectively, the “Service”).
By using the Service, you acknowledge the practices described in this Privacy Policy. If you do not agree with this policy, please do not use the Service.
1. Information We Collect
1.1 Account Information
When you create or use an account, we may collect information such as your email address, display name, profile photo, authentication provider, user identifier, sign-in status, and account-related settings.
1.2 Learning and Exam Data
We may process information generated while you use the Service, including selected answers, test progress, test history, scores, saved progress, mistake-book entries, written responses, speaking responses, transcripts, AI feedback, and usage-limit data.
1.3 Microphone and Audio Data
The Speaking features may request access to your device microphone so that you can record an answer. Microphone access is used only when you choose to use a speaking or recording feature.
When you request an AI evaluation, your recording, an audio-derived transcript, or related response data may be transmitted to our service providers for processing and generation of feedback. We do not activate the microphone without your action and permission.
1.4 Purchase and Subscription Information
Premium subscriptions and in-app purchases are processed by Google Play or the Apple App Store. We may receive information such as subscription status, product identifier, entitlement status, renewal status, and transaction verification data. We do not receive or store your full payment-card details.
1.5 Device, Technical, and Usage Information
We and our service providers may automatically process technical information such as device type, operating system, app version, language, IP address, authentication logs, crash information, diagnostic information, and interactions with app features.
1.6 Support Communications
If you contact us by email, WhatsApp, or another support channel, we may process your contact details, message content, screenshots, attachments, and any information you choose to provide.
2. How We Use Information
We may use information to:
- provide, operate, maintain, and secure the Service;
- create and manage accounts and authentication;
- save exam progress, results, preferences, and premium status;
- provide AI-assisted speaking and writing evaluations;
- apply free and premium usage limits;
- process and verify subscriptions and purchases;
- respond to support requests and troubleshoot problems;
- detect fraud, abuse, security incidents, or violations of our terms;
- improve app reliability, usability, and educational features;
- comply with legal obligations and enforce our rights.
3. AI Processing
WineExam uses third-party artificial-intelligence services to evaluate certain speaking and writing responses. When you request an AI evaluation, relevant content such as your written response, question text, transcript, audio-derived content, and technical request data may be sent to an AI service provider solely to generate the requested result and maintain the security of the service.
AI-generated scores, corrections, explanations, and feedback are automated outputs. They may be incomplete, inconsistent, or inaccurate and should not be treated as an official TOEFL score or as a decision made by ETS or any examination authority.
4. Service Providers and Data Sharing
We do not sell your personal information. We may share or process information with service providers only as reasonably necessary to operate the Service, including:
- Google Firebase services for authentication, account management, database, and related infrastructure;
- OpenAI or another AI-processing provider for requested speaking and writing evaluations;
- Google Play and Apple App Store for subscriptions, purchases, and entitlement verification;
- hosting, security, diagnostics, communications, and technical-support providers;
- government authorities or other parties when required by law or necessary to protect rights, safety, and security.
These providers may process information in countries other than your country of residence and under their own legal and security obligations.
5. Data Storage and Retention
We retain information only for as long as reasonably necessary to provide the Service, maintain account and subscription records, comply with legal obligations, resolve disputes, prevent abuse, and enforce agreements.
Some exam progress or settings may be stored locally on your device. Account, entitlement, AI-request, or support information may be stored by us or our service providers. Retention periods may vary depending on the type of data and the provider.
Deleting the app from your device does not automatically delete account information held by remote service providers.
6. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information. However, no system, transmission method, or storage method is completely secure, and we cannot guarantee absolute security.
7. Your Choices and Rights
Depending on your location and applicable law, you may have rights to request access, correction, deletion, restriction, objection, portability, or withdrawal of consent regarding your personal information.
You can deny microphone permission through your device settings. Doing so may prevent speaking-recording features from functioning.
To request account or personal-data deletion, contact us using the email address below. We may need to verify your identity before completing a request. Certain information may be retained when required by law or for legitimate security, fraud-prevention, accounting, or dispute-resolution purposes.
8. Children’s Privacy
The Service is not directed to children under 13, or under the minimum digital-consent age required in the user’s jurisdiction. We do not knowingly collect personal information from children in violation of applicable law.
If you believe a child has provided personal information without appropriate authorization, contact us so that we can review and, where appropriate, delete it.
9. International Data Transfers
Your information may be processed and stored in countries where our service providers operate. Data-protection laws in those countries may differ from those in your country. Where required, we rely on appropriate legal mechanisms for international transfers.
10. Third-Party Links and Services
The Service may link to third-party websites, stores, or services. Their privacy practices are governed by their own policies, and we are not responsible for those practices.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The revised version will be posted on this page with an updated “Last updated” date. Where required, we may provide additional notice inside the Service.
