These Terms and Conditions (“Terms”) govern your access to and use of the WineExam mobile applications, website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
If you do not agree to these Terms, do not access or use the Service.
1. About the Service
WineExam provides educational practice materials, mock examinations, progress tools, and AI-assisted feedback for English-language and international examination preparation.
WineExam is an independent educational product. It is not affiliated with, endorsed by, sponsored by, or officially connected with ETS, TOEFL, IELTS, Cambridge University Press & Assessment, Pearson, Duolingo, OET, CELPIP, College Board, or any other examination owner unless expressly stated.
All examination names and trademarks belong to their respective owners and are used only to identify the type of examination preparation offered.
2. Eligibility and Accounts
You must be legally able to enter into these Terms. If you are under the age of legal majority in your jurisdiction, you may use the Service only with the permission and supervision of a parent or legal guardian.
You are responsible for maintaining the confidentiality of your account credentials and for activities performed through your account. You must provide accurate information and promptly notify us of suspected unauthorized access.
3. Acceptable Use
You agree not to:
- use the Service for unlawful, fraudulent, abusive, or harmful purposes;
- attempt to bypass premium access, AI limits, subscriptions, security controls, or technical restrictions;
- copy, scrape, extract, republish, sell, sublicense, or systematically reproduce app content or question databases;
- reverse engineer, decompile, modify, interfere with, or disrupt the Service except where applicable law expressly permits it;
- upload malware, harmful code, unlawful content, or content that infringes another person’s rights;
- misuse AI features or submit content containing unnecessary sensitive personal information;
- use automated systems to create excessive requests or impose an unreasonable load on the Service;
- impersonate another person or misrepresent your identity or affiliation.
4. Educational and AI Disclaimer
The Service is intended for practice and educational support only. It does not guarantee admission, certification, employment, visa approval, a particular examination result, or improvement by a particular amount.
AI-generated evaluations, scores, transcripts, corrections, explanations, and feedback are automated estimates. They may contain errors, omissions, or inconsistencies and are not official examination results.
You remain responsible for reviewing AI output and deciding how to use it. Do not rely on the Service as the sole source for high-stakes educational, legal, immigration, employment, or financial decisions.
5. Free Features, Premium Features, and Usage Limits
The Service may offer free and paid features. Available tests, AI evaluations, storage, usage limits, and premium benefits may differ by plan, platform, country, promotion, or app version.
We may reasonably modify free limits, premium limits, features, content availability, and technical requirements. Material changes affecting an active paid subscription will be handled in accordance with applicable law and the relevant app-store rules.
6. Subscriptions and In-App Purchases
Purchases and subscriptions are processed by Google Play or the Apple App Store. Prices, taxes, billing periods, free trials, renewal terms, cancellation procedures, and refund eligibility are shown by the relevant store before purchase.
Unless cancelled through your store account before the applicable renewal deadline, subscriptions may automatically renew and the store may charge the payment method associated with your account.
WineExam does not directly control app-store billing or refunds. Refund requests are generally handled under the policies of Google Play, Apple, and applicable consumer law.
Deleting the app or your WineExam account does not necessarily cancel an app-store subscription. You must manage or cancel the subscription through the store account used to purchase it.
7. User Content
“User Content” includes written responses, speaking recordings, transcripts, support messages, and other material you submit through the Service.
You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide right to host, transmit, process, reproduce, and technically modify User Content only as reasonably necessary to operate, secure, support, and improve the Service and to provide features you request, including AI evaluation.
You represent that you have the right to submit your User Content and that it does not violate law or third-party rights.
8. Intellectual Property
The Service, including its software, design, branding, original questions, explanations, graphics, databases, and other content, is owned by or licensed to WineExam and is protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own educational purposes. No ownership rights are transferred to you.
9. Privacy
Our collection and use of personal information are described in our Privacy Policy, which forms part of these Terms.
10. Availability and Changes
We aim to provide a reliable Service, but we do not guarantee uninterrupted, error-free, or permanently available access. Features may be temporarily unavailable because of maintenance, internet problems, third-party services, device limitations, security concerns, or events outside our control.
We may update, modify, suspend, or discontinue features or content where reasonably necessary. We may also release corrections, compatibility updates, or security updates.
11. Suspension and Termination
We may restrict, suspend, or terminate access when we reasonably believe that you have violated these Terms, created security or legal risk, abused the Service, failed to pay applicable charges, or used the Service in a way that could harm users, WineExam, or third parties.
You may stop using the Service at any time. Account deletion does not automatically cancel a subscription purchased through an app store.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
13. Limitation of Liability
To the maximum extent permitted by law, WineExam will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, opportunity, examination fees, travel costs, or expected results arising from use of or inability to use the Service.
Where liability cannot be excluded, it will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability that cannot legally be limited.
14. Indemnity
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person’s rights.
15. Governing Law and Consumer Rights
These Terms are governed by the laws applicable to the Service provider, without excluding mandatory consumer protections available to you under the laws of your country of residence.
Any dispute should first be submitted to us through the contact address below so that the parties can attempt to resolve it informally.
16. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with a new “Last updated” date. Continued use after the effective date of revised Terms means you accept the updated Terms, except where applicable law requires another form of consent.
